RIAI Clause 26 Insurance Facility

Glennon have a bespoke insurance facility for damage caused to an existing structure during the course of construction works.

This facility provides cover for damage to an existing structure, including Employer’s contents and Consequential Loss, as required under Clause 26 of the RIAI contract conditions (or other similar contract conditions / requirements).

This solution has been developed with the following parties in mind:

  • Contractors

Possible Implications and Exposures

The standard RIAI building contract places sole responsibility on the “Employer” to insure damage to existing structures and contents during the period of such alteration or repair.

This means that, contractually, it is unlikely that repair costs can be recovered from a contractor in the event of damage to existing structures even where the contractor is responsible.

The Contractor is entitled to a waiver of such rights of recovery from the Employer’s property insurer. The Employer and/or their property insurer can often refuse to provide such a waiver of rights of recovery to the contractor. The property insurer may also seek to restrict cover further in some instances.

This leaves the substantial and often uninsured risk of loss of damage to existing structures and their contents with the Employer.

The Employer needs to be aware of this exposure and plan to insure it before the contract begins.
